Privacy Policy

Cambalt Solutions, Inc. (d/b/a Bento) (“Bento,” “we,” “us,” or “our”) own or license all right, title, and interest in and to the website located at www.bento.net (the “Service”). All references to “you” or “your” refer to the person accessing or using the Service.

Your use of the Service is subject to our End User License Agreement. This Privacy Policy explains how we collect and use personally identifiable information and non-identifying information about you when you access or use the Service.

PLEASE READ THIS PAGE CAREFULLY. BY ACCESSING THE SERVICE OR SUBMITTING YOUR PERSONAL INFORMATION (DEFINED BELOW) IN ORDER TO RECEIVE THE SERVICE, YOU AGREE TO THE TERMS SET FORTH IN THIS PRIVACY POLICY. IF YOU DO NOT ACCEPT THE TERMS OF THIS PRIVACY POLICY, DO NOT ACCESS OR USE THE SERVICE.

Bento will notify you of any changes to this Privacy Policy by posting the modified Privacy Policy and its effective date on this page. Accordingly, you should visit this page periodically to identify and understand any such changes. By continuing to access or use the Service after a modification, you agree to be bound by the modified Privacy Policy.

1. INFORMATION COLLECTED BY BENTO

(a) Collection of Personal Information. “Personal Information” means all personally-identifiable information (such as your name, social security number, physical address, e-mail address, telephone numbers, or birth date and payment information) that you submit in connection with the Service. Bento does not collect Personal Information unless you voluntarily submit it in connection with your use of the Service, send inquiries to Bento or participate in certain activities available via the Service. We collect Personal Information when you choose to use certain features of the Service, including when you: (i) create an account; (ii) engage in certain activities available via the Service as they may be available from time to time; or (iii) consent to receive commercial or promotional email, direct mail, in-application notifications, so-called “push notifications”, or SMS/text messages about upcoming promotions or events. Under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (collectively, “HIPAA”), certain of the information that you provide to Bento may be considered to be “protected health information” (including “electronic protected health information”) or “PHI.” HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. Bento may only use and disclose your PHI in the ways permitted by HIPAA.

(b) Information Gathered Automatically. (i) Bento automatically collects certain non-identifying information about you (such as your movement about the Service and the pages or content you view most frequently, the type of browser or operating system you use, or the domain name of the website from which you link).

(ii) In addition, Bento may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices’ unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile internet browsers you use, and the information about the way you use the Service.

(iii) Bento may collect other passive information using technologies such as standard server logs, cookies and clear GIFs (“Web Beacons”). Web Beacons are small pieces of information or data stored on your computer or mobile device that are used to determine your preferences and track your search terms and other behaviors or activities as you navigate around the Internet (collectively, “User Behavior”). If you object to this practice, you may erase or block certain Web Beacons. We recommend, however, that you allow Web Beacons to be stored on your computer or mobile device as they may be needed to properly use the Service.

(iv) Additionally, Bento may also use “Cookies” and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the information for which you searched and viewed. This type of information is collected to better understand how you use the Service and to make the Services more useful to you. Most browsers are automatically set to accept Cookies. (c) Information on Location Data. Bento may collect, maintain, process and use your location data, including the real-time geographic location of your mobile device as necessary to provide the Service’s full functionality. By using or activating any location-based services on a mobile device, you agree and consent to Bento’s collection, maintenance, publishing, processing and use of your location data to provide you with the Service. User may withdraw this consent at any time by turning off the location- based feature on a mobile device or by not using any location-based features. Turning off or not using these features may impact the functionality of the Service. Location data provided by the Service is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage. Use of real time route guidance is at your sole risk. Location data may not be accurate. Bento does not guaranty the availability, accuracy, completeness, reliability or timeliness of information or location displayed by the Service.

(d) Your Content. Except for Bento’s obligations concerning your Personal Information as set forth herein, Bento assumes no responsibility for securing any other content you submit via the Service.

(e) Mobile Number. If you provide us with your phone number, you agree to receive text messages to that number from us.

2. CHANGING OR REMOVING YOUR PERSONAL INFORMATION
You can also deactivate and permanently delete your Bento account by following the instructions here. Bento may retain any Personal Information that you submit in connection with your account and you understand that deleted Personal Information may persist for a reasonable period of time in backup copies but will not be available to others.

3. USE OR DISCLOSURE OF YOUR INFORMATION
Bento may use your Personal Information to contact you regarding the Service. We may also use your Personal Information to provide services requested by you and for internal research and marketing purposes.

Bento may share your User Behavior within the Service with certain advertisers and such advertisers may respond to your User Behavior within the Service with advertisements or sponsored content.

Bento shall have the right to utilize data capture, syndication and analysis tools, and other similar tools, to extract, compile, synthesize, and analyze any non-personally identifiable data or information resulting from your access and use of the Service (“Blind Data”). To the extent that any Blind Data is collected by Bento, such Blind Data shall be solely owned by Bento and may be used by Bento for any lawful business purpose without a duty of accounting to you.

Except as otherwise set forth herein, Bento will not use, disclose, or sell your Personal Information to any third parties for any purposes other than those set forth herein or as may be necessary to deliver the Service.

The Personal Information, User Behavior and non-identifying information we collect from you may be used as follows:

to identify you when you login to your account and to personalize your experience and better respond to your individual needs; to provide and improve the Service;
to analyze the Service and information about our visitors and users, including research into our user demographics and user behavior in order to improve our content and Service;

to contact you regarding your account, the Service or otherwise improve our customer service;
to share aggregate (non-identifiable) statistics about users of the Service to prospective advertisers and partners;
to administer contests, promotions, surveys or other features for the Service;
to send periodic mailings concerning information and updates pertaining to Bento; or
to send special or promotional offers or discounts related to Bento or its affiliates and information related to products you have viewed via the Service.
Notwithstanding the foregoing or any other statements or representations here or elsewhere, Bento reserves the right to disclose any Personal Information in our possession if Bento believes that such disclosure is necessary: (i) to conform to legal requirements or to respond to a subpoena, search warrant, or other legal process received by Bento, whether or not a response is required by applicable law; (ii) to enforce or protect Bento’s rights; or (iii) to protect the safety of users of Bento’s Service and members of the general public.

In the event that Bento or the Service is sold or transferred, or in the event that substantially all of our assets are sold or transferred to a third party, the Service and any personally identifiable information collected by us, will be among the transferred assets. By using the Service, you hereby consent to such transfer or assignment of any of your information collected by us, and you further waive any claims that could be made against us in relation thereto.

BY SUBMITTING ANY CONTENT THROUGH THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT THE THIRD PARTY APPLICATIONS WILL PUBLICALLY DISSEMINATE SUCH CONTENT. NO USER CONTENT IS OR WILL BE SUBJECT TO ANY OBLIGATION OF CONFIDENCE ON THE PART OF BENTO.

4. SECURITY
Bento has reasonable security measures in place to protect Personal Information you submit in order to receive the Service. While no computer system or server is completely secure, we believe the measures we implement reduce security problems. Notwithstanding the foregoing, Bento cannot guarantee the security of your Personal Information. When you communicate with Bento electronically or otherwise submit your Personal Information, your communication is not necessarily secure and is subject to all of the risks of communication, including unauthorized entry or use, hardware or software failure, and other factors that may compromise the security of Personal Information at any time. Additionally, Bento cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur and cannot be held liable for any unauthorized access or use of your data. You use of the Services is at User’s own risk and Bento assumes no responsibility for the security of any Personal Information you submit.

5. LINKS
We may permit certain third parties to link to our Service, and the Service may contain links to third-party sites. Bento is not responsible for the privacy policies or practices of such third parties, including on such third parties’ websites. When linking to a third party website, you should read the privacy policy stated on that website. This Privacy Policy only governs Personal Information, non-identifying information and content collected in connection with the Service.

6. ADDITIONAL PROTECTIONS FOR CHILDREN
The Service is not designed for or targeted to children under the age of 13, and Bento will never knowingly solicit or collect the Personal Information of a child under the age of 13 without the consent of a child’s parent or guardian. If we discover that Personal Information of a child under the age of 13 has been submitted without verifiable parental and/or guardian consent, we will immediately delete such Personal Information.

7. CALIFORNIA PRIVACY RIGHTS
Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2017 will receive information regarding 2016 sharing activities).

We will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.
